As a business owner in the UK, you have a legal duty of care to ensure your waste is managed properly. This guide explains your responsibilities and how to stay compliant.
Your Duty of Care
Under the Environmental Protection Act 1990, all businesses must:
- Store waste safely and securely
- Use a licensed waste carrier
- Complete accurate waste transfer notes
- Prevent waste from escaping
- Ensure waste is disposed of at an authorised facility
Waste Transfer Notes
Every time your waste is collected, you must receive a Waste Transfer Note (WTN). This document must include:
- Description of the waste
- Quantity of waste
- Date of transfer
- Names and addresses of both parties
- Waste carrier licence number
You must keep WTNs for a minimum of 2 years (or 3 years for hazardous waste).
Checking Your Waste Carrier
Before using a waste removal company, verify they're registered with the Environment Agency. You can check online at environment.data.gov.uk. Using an unlicensed carrier can result in fines up to £5,000.
Hazardous Waste Requirements
If your business produces hazardous waste (oils, chemicals, batteries, etc.), additional requirements apply:
- Register as a hazardous waste producer
- Use consignment notes (not WTNs)
- Keep records for 3 years
- Use specialist carriers
Penalties for Non-Compliance
Failure to comply with waste regulations can result in:
- Fixed penalty notices up to £300
- Prosecution and unlimited fines
- Prison sentences for serious offences
- Reputational damage to your business
